Decoding RERA as it turns 1

Real Estate Regulatory Act, commonly known as RERA, was initially enacted on 26th March 2016. From 1st May, 2017 all its provisions came into effect and infused a fresh breath of air for home buyers across the country. With a clear cut intention of protecting the interests of home buyers from the malpractices of unfair builders while enhancing transparency in the real estate sector, RERA also aims to boost investments in the real estate sector.&nbsp;Before the implementation of RERA thousands of home buyers filed complaints against their developers for malpractices. Real estate transactions were also heavily biased in favour of the developers. In a nutshell, developers played the real estate game on their own made-up terms. Coming to their rescue, RERA is acting like a bridge to create equitable and fair transactions between the seller and the buyer. As the first regulator in the Indian real estate industry, RERA is making buying property simpler by bringing in better accountability.&nbsp;How RERA changed the real estate game&nbsp;The introduction of RERA has brought in a wave of positivity into the real estate sector. Providing a unified legal regime, RERA is standardizing the purchase practices of apartments, flats, etc. across the country. The key highlights of RERA that matter the most are:<ul><li>It establishes a Real Estate Regulatory Authority in each state and UT. Working towards the protection of interests of the stakeholders, accumulating data at a designated depository and creating a robust grievance redressal system, it also aims to prevent time lags and makes it mandatory to dispose applications within 60 days max.</li><li>It makes registration compulsory for any real estate project where the total area is more than 500 square meters with its respective state’s RERA. Promoters are required to provide detailed information about the project while applying for its registration. Once these details like land status, promoter information, approvals, schedule of completion, etc. are duly provided, then only the project can be marketed.</li><li>It prevents diversion of funds from one project to another and requires promotors to park 70% of all project receivables into a separate reserve account. So the money can only be used towards the purchase of land and construction expenses. Also it makes sure that all the proceedings are looked after by a certified professional.</li><li>It requires promoters to make continuous disclosures of the progress of the project on the RERA website. So home buyers can track the progress of the project through the periodic submissions made by the promoters.</li><li>It requires a promoter to make a positive warranty on his right title and interest on the land. This warranty, if and when needed, can be used against him by the home buyer if any title defect is discovered. The promoter is also required to obtain insurance against the title and construction of the project.</li><li>It requires the standardization of the sale agreement to be entered by promoters and home buyers. It also introduces some penal clauses that restrict promoters to insert punitive clauses against home buyers.</li><li>It imposes a heavy monetary penalty (that may go up to 10% of the project cost) to ensure that the act is not violated. Depending up on the severity of the violation, imprisonment can also be prescribed in some scenarios.</li></ul>&nbsp;Compliances benefitting the home buyers&nbsp;Home buyers, with RERA coming into play, will get the compliance benefits they have always longed for. Some of the most important compliances are:<ul><li>Any minor addition or alteration will be informed about</li><li>About any addition or alteration, prior consent of 2/3rd allottees is required</li><li>Before registration with RERA no launch or advertisements are allowed</li><li>To transfer majority rights to a 3rd party, consent of 2/3rd allottees is required</li><li>Mandatory to share project plan, layout, government approvals, land title status and sub-contractors</li><li>Timely completion of projects and delivery to the consumer is to be followed strictly</li><li>Due to a defect liability period of five years, an increase in the quality of construction is required</li><li>After majority of units have been sold, formation of RWA within specified time or 3 months is required</li></ul>&nbsp;RERA is the act every home buyer was looking forward to. In just one year it has made a very positive impact on India’s real estate sector. And this is just the beginning. How to bring down your home loan interest

While buying a home, apart from the most crucial aspects like the right property of choice, location, savings, etc., the key factor remains the home loan and the interest rate offered by banks and other financial institutions. It is very important to develop a clear understanding about the interest rates, the reason of the variation in rates, the long-term effect on the EMIs, and rules and processing charges about future transfer of loan from lender bank to some other bank or institution.&nbsp;Understandably, EMIs form the largest expenditure of a household on a monthly basis that stretches for over a decade or two decades. A slight difference in rate of interest on home loan offered by various banks and financial institutions, which may appear negligible in the beginning, has a significant impact on the amount paid in the longer run. Hence, the emphasis on understanding the fine-print and choosing the best lender for a particular property, city or amount of loan required. This way you can reduce the burden and mitigate the impact the home loan would have on your income. Lower interest rates is a dynamic phenomenon that buyers should take advantage of instead of continuing with lenders with higher interest rates.&nbsp;The following are a few tips that help you take advantage of lower interest rates through various methods:&nbsp;Transfer your loan to MCLR&nbsp;It was a long-standing complaint of home loan borrowers with banks that banks ignore the existing borrowers when reducing interest rates benefitting new borrowers. Reserve Bank of India had also accused banks of not passing on the benefits of lower interest rates to the existing base of borrowers. Then came the RBI intervention aimed at resolving this discrepancy when RBI mandated banks to switch over to Marginal Cost Based Lending Rate (MCLR) based lending rates from April 01, 2016. With this initiative, all new floating rate home loans are processed on the basis of MCLR. And an equally significant rider that came through was the option that even the loans issued before April, 2016 can now be transferred to MCLR if the existing lender has higher interest rate. Previous borrowers can now switch their balance home loan to any other bank that offers lower interest rate.&nbsp;In comparison to the base rate and BPLR systems, MCLR is a more dynamic and effective option that is directly linked with repo rate. Thus, MCLR reflects the changes in the policy rates immediately, and you get the benefit of lower interest rates much faster. Repo rate is used to calculate MCLR making it more reflective of any changes in the policy rates and beneficial for home buyers. Moreover, RBI has made it mandatory for the banks to review their MCLR on a monthly basis and reset the interest rate at a periodic interval of less than a year. And this mechanism of resetting the interest rates and schedule have to be clearly communicated to the borrowers by the bank at the time of disbursing the home loans. These guidelines and rules have rendered MCLR a much more transparent rate-setting mechanism. Now the banks are bound to pass over the benefits of repo-rate reduction to the borrowers based on the provision of fixed interest rate reset schedule.&nbsp;In recent years, a decline in the interest rate has been registered, thereby, making it an attractive option to switch to MCLR so that you benefit from future rate reductions. But for this switch to MCLR, your current lender bank may charge a conversion fee of about 0.5% on the outstanding amount of home loan, with taxes. Also, it is important to note here that switching to MCLR is a one-time option which means that once you have opted for MCLR, you cannot go back to previous system or rate.&nbsp;Reset your loan to lower rate, in case of NBFCs&nbsp;Since, home loans from Housing Finance Companies (HFCs) and Non-Banking Financial Companies (NBFCs) currently do not come under the purview of MCLR, the borrowers may choose to reset their home loans to the current lending rate to enjoy the benefits of lower interest rate. Borrowers may be charged a conversion fee of upto 1% of the outstanding loan amount for this resetting to lower rate. Similarly, banks also provide this facility of switching from higher fixed rate to lower rate on the payment of a conversion fee. Different lenders may charge different conversion fee. With NBFCs and HFCs, the base rate doesn’t change, only the spread changes. For example, a lending agency has a base rate of 15 per cent and a spread of -5 per cent, then it would allow you to change your spread to minus six per cent. This results in a drop of interest rate bringing it closer to about 9% [15 + (-6)]. With this provision, the borrowers may continue with the same EMIs, and even go for reducing the loan tenure.&nbsp;Settle your loan in part or full with prepayments&nbsp;With the restriction on lenders from charging prepayment of floating rate home loans, it is now easier for home loan borrowers to settle their outstanding home loan balance, fully or partially, by making prepayments. However, this restriction, as mentioned above, is only for home loans based on floating rate. For fixed rate home loans, lending agencies charge prepayment charges of upto 2% of the outstanding loan amount.&nbsp;In case of going for prepayment, it is advisable to ascertain that saving you make in interest amount is higher that the prepayment charges you are paying.&nbsp;Refinance your balance home loan&nbsp;In case, you find that your current lender isn’t ready to reduce the interest rate and/or reset other terms and conditions, you can go for the option of refinancing your balance home loan, or in other terms, transfer the balance home loan to the other more suitable lender. Elevated Six-Lane Corridor to South of Gurgaon

In August 2016, NHAI took over the Gurgaon-Alwar Road from PWD and declared it a national highway called NH-248. It also announced the project to convert it into a four-lane highway along with an elevated corridor from Rajiv Chowk to Alipur near Bhondsi, a 16.5 km stretch. The 96 km stretch connects NH 8 at Rajiv Chowk in Gurgaon and Naugaon in Ramgarh, in Rajasthan at Haryana-Rajasthan border, passing through Sohna, Nuh, Firozpur, Jhirka to Naugaon.&nbsp;Recently, Ministry of Road Transport and Highways ordered the extension of the elevated corridor till Sohna, an entire stretch of 23 km. It also asked NHAI to revise the original plan of four-lane to six-lane corridor. This has come as a breather for commuters from Rajiv Chowk to Sohna making the 23 km long stretch a faster and comfortable drive skipping the mad traffic snarls and congestions. This will help motorists get to Sohna, about 23km away, in far quicker time than they do now. One&nbsp;NHAI&nbsp;official expressed his view of this development, “This has now been extended for another 6 km, and will now go beyond Sohna. It will give a big breather to commuters going from Rajiv Chowk to Sohna rural.”&nbsp;On the proposed increase in the number of lanes, he said, “NHAI is making necessary changes in its detailed project report to accommodate the changes, after they received an order from the ministry last week.” The elevated corridor project is expected to kick start by August this year.&nbsp;This development when implemented will immensely benefit the population of Sector 33, 66, 67, and Jharsa, Islampur, Fazlipur, Badshahpur, Bhonsi and Sohna. With the real estate development in Gurgaon and trade increasing, this highway has grown into a very significant route for people in Rajasthan and Haryana. Reports suggest that over 50,000 vehicles ply on this highway every day and is an important business route for transportation of goods, including dairy products, to Gurgaon and Delhi.As of now, the 95 km Gurgaon-Alwar highway is largely two-lane and extremely congested at many spots, especially residential areas like Badshahpur, and has no service roads.
